Terms of Use
These terms govern the engagement between AutoBook (the "Company", "we", "us") and the business ordering the service (the "Client"). Accepting these terms on this page, or paying for the service, constitutes full and unconditional acceptance of these terms and of the Privacy Policy.
1. The service
- The Company sets up and operates for the Client an AI-based chatbot that answers customer inquiries based on the information provided by the Client and handles appointments in one of the following ways: collecting details and emailing them to the Client, directing customers to the Client's booking system, or booking, cancelling and changing appointments directly in the Client's Google Calendar.
- The chatbot will operate on the channels included in the selected package (for example, a website or a dedicated link).
- As part of the service, conversation records, summaries and statistics are retained and made available to the Client in accordance with Section 5 below.
2. Pricing and payment
- The service includes a one-time setup fee and a monthly fee, as stated in the quote provided to the Client.
- Payment is made in advance. Work on the chatbot will begin only after payment is received.
- The monthly fee for the selected package will remain fixed for the entire engagement. Adding channels, features or additional services involves an additional charge, according to the price list in effect at that time.
- Promotions and benefits (such as a free first month) apply only if explicitly stated in the quote.
3. Cancellation and refunds
- The Client may cancel the service at any time with 30 days' written notice.
- The setup fee is non-refundable once work on the chatbot has begun.
- Monthly fees already paid are not refunded pro rata for the month in which the service is cancelled.
4. Client responsibilities
- The Client is responsible for ensuring that the information it provides (services, prices, service durations, opening hours and policies) is accurate and up to date, and for notifying the Company of any change.
- Where the chatbot is connected to the Client's calendar, the Client is responsible for entering into the calendar any appointment, block or change made other than through the chatbot.
- The Client is responsible for complying with the privacy and consumer protection laws that apply to it toward its own customers, including informing them about the use of the chatbot and the retention of conversation records, and for using the information lawfully and for legitimate purposes only.
- The Client agrees not to use the service for any unlawful, misleading or abusive purpose.
5. Conversation records, data and retention
- The Company retains the full content of conversations held with the Client's chatbot, together with summaries and statistics, and makes them available to the Client for handling inquiries, monitoring and improving its service.
- Access to the records is limited to the Client and the Company. The Company will access the information solely for operation, support, security and service improvement.
- Conversation records and summaries will be retained for up to 12 months from the date of each conversation and will then be deleted automatically. (The retention period may be changed only upon a prior written request by the Client to the Company, and any such change is subject to the Company's review and approval.)
- With respect to the information of end customers, the Client is the owner of and party responsible for the information, and the Company processes it on the Client's behalf and solely in accordance with its instructions.
6. Service limitations
- The chatbot is AI-based and may make mistakes. It answers solely based on the information provided by the Client and does not provide medical, legal or professional advice.
- Where the chatbot is connected to the Client's calendar, it books appointments according to the availability shown in the calendar and the opening hours set by the Client. Where the chatbot is not connected to a calendar, it does not guarantee availability, and final confirmation of appointments is the Client's responsibility.
- The Company does not collect payments from end customers, including cancellation fees. Any decision regarding such charges rests solely with the Client.
- The service relies on third-party providers (such as Google, Cloudflare and Meta). The Company does not guarantee uninterrupted, error-free availability, but will act to fix issues as soon as possible.
7. Limitation of liability
- The Company will not be liable for indirect, consequential or special damages, including loss of revenue, profits or customers.
- In any event, the Company's total liability will not exceed the amount actually paid by the Client in the three months preceding the event giving rise to the claim.
8. Suspension
In case of non-payment or breach of these terms, the Company may suspend the service after notifying the Client.
9. Intellectual property
The service's system, code, design and software are the exclusive property of the Company. Content and information provided by the Client remain the Client's property.
10. End of engagement
When the engagement ends, the chatbot is deactivated. Upon the Client's request submitted before the end of the engagement, a copy of the stored information will be provided, and the information will be deleted within 30 days of the end date.
11. Changes to these terms
The Company may update these terms with 30 days' notice to the Client. Changes will not affect the monthly fee of the selected package.
12. Governing law and jurisdiction
These terms are governed by the laws of the State of Israel, and the competent courts in Israel shall have exclusive jurisdiction.
